Part A: Bargaining Power:

The bargaining power of both sides is affected by a number of factors. Identify and discuss some factors that influence bargaining power and how they impact both sides of the table during collective bargaining. What are some of the specific factors in this particular case study?

Part B: Contract Negotiation Simulation

Conduct an analysis of the current collective agreement, identifying areas of concern for both management and the union:

  1. Review the provisions of the collective agreement. Identify five (5) areas of potential concern for management and five (5) areas of potential concern for the union (e.g. what provisions in the current contract terms may pose problems or concerns to the negotiating parties leading to their demands).
  2. Based on the concerns and/or issues you have identified, prepare three (3) proposals on behalf of the Union (to present to management); and three (3) proposals on behalf of management (to present to the Union) to amend the current collective agreement
  3. Explain: (a) your rationale for your proposed amendments; (b) what you anticipate the other party to come back with; and (c) how you will negotiate through it to ultimately reach an agreement. (Include strategies, concessions and supporting key figures where necessary to support your rationale).

By way of a guideline, your assignment should be no more than 3500 words (3-4 pages single-spaced) in 11 or 12-point fon
